Terms of service

EFFECTIVE FROM: 11 October 2024
Website: nathandownie.com

These Terms apply to your use of nathandownie.com and any purchase made through the website (including mobile and tablet versions).

By accessing the site or placing an order, you agree to these Terms.

1) Who we are

This website is operated by Nathan Downie (“we”, “us”, “our”).

2) Eligibility

You must be able to form a legally binding contract to place an order. If you are under 18, you must have permission from a parent/guardian.

3) Orders

When you place an order, you are making an offer to buy products at the price shown at checkout.

We may refuse or cancel an order if it is reasonable to do so (for example: suspected fraud, a pricing error, or product availability). If we cancel an order after payment is taken, you will be refunded for that order.

Please review variants, sizing, and product information before purchase.

4) Made-to-order fulfilment

Many items are produced made to order. This can affect dispatch times. See our Shipping Policy for current fulfilment and delivery information.

5) Prices and errors

Prices are shown on the website and may change at any time. If an obvious pricing error occurs, we may cancel the order and refund you, or contact you to confirm whether you still wish to proceed at the correct price.

6) Payments

We accept payment methods shown at checkout (for example, card and PayPal where available). Payment is taken at the time you place your order.

7) Product information

We aim to display products accurately. Colours and appearance may vary depending on your device screen. Product descriptions, sizing charts, and images are provided for guidance.

8) Returns and refunds

Our Return & Refund Policy applies to all purchases and forms part of these Terms.

We operate on a final sale basis, except where required by law. UK/EU consumer cancellation rights may apply to eligible purchases.

9) Intellectual property and anti-copycat terms

All site content (including text, images, video, designs, graphics, and artwork) is owned by or licensed to us and protected by intellectual property laws.

Purchases (prints / originals / merch)
Unless we agree otherwise in writing:

-Copyright remains with Nathan Downie.

-Your purchase grants a personal-use licence only (owning/displaying the physical item).

-You may not reproduce, scan, copy, distribute, sell, license, publish, or create derivative works from any design/artwork, or use it commercially. Commercial use includes (without limitation) prints, merchandise, digital products, advertising, templates, or any revenue-generating use.

-Any permitted use must be approved in writing in advance.

Names and marks
“Nathan Downie” and associated names/marks may not be used in a way that suggests affiliation, sponsorship, or endorsement without written permission.

No scraping / automated extraction / training
You must not scrape, harvest, automatically download, index, or extract content from the website, or use site content to create datasets, train models, emulate style for competing outputs, or reproduce competing products or designs.

10) Acceptable use

You agree not to:

-misuse the website or attempt unauthorised access,

-interfere with security features,

-use bots/scrapers without permission,

-upload or transmit malware,

-use the site in a way that breaches any law.

11) Third-party services and links

The website may reference or link to third-party services (e.g., payment processors or fulfilment partners). We are not responsible for third-party websites or services.

12) Liability (consumer rights preserved)

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

To the extent permitted by law, we are not responsible for losses that are not reasonably foreseeable, or for business losses (loss of profit, business interruption, etc.). These Terms do not affect your statutory rights as a consumer.

13) Changes to the website and Terms

We may update the site and these Terms from time to time. The version in force at the time of your order will apply to that order.

14) Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales, subject to any mandatory consumer protections that apply in your country of residence.
